THE Government of Jamaica yesterday remained mum over the latest claims by American law firm Manatt, Phelps & Phillips that the State paid it US$15,000 more for lobbying work on its behalf than was previously disclosed.
Manatt, Phelps & Phillips is the same law firm that Jamaica Labour Party (JLP) affiliates reportedly hired, after being given approval by Prime Minister Bruce Golding, to lobby the United States government on the extradition request for former West Kingston 'don' Christopher 'Dudus' Coke, which was made last August.
Prior to an admission by Golding in May this year that he had sanctioned the initiative, the Government had insisted that no arrangement was reached between itself and the firm. It, however, said that solicitor general Douglas Leys met with representatives of Manatt, Phelps & Phillips at the invitation of attorney-at-law Harold Brady but merely for "exploratory discussions" contrary to the firm said. It also said that any money which had changed hands was through a link between Brady and the firm.
But in a new Foreign Agents Registration Act (FARA) filing with the Justice Department, Manatt said it had got $15,000 more than the US$49,892.62 that was originally disclosed.
According to the 24-page supplemental filing dated June 30, the activities done under the firm's agreement with Jamaica involved consultations with Molly Warlow, director of the Justice Department's Office of International Affairs, about extradition matters.
Particularly, the filing states that Manatt lawyers met with Warlow on December 17, 2009, to thrash out "extradition treaty process requirements". The filing made no mention of Coke.
Like in previous FARA filings, Manatt maintains that it "represented the Government of Jamaica in the US regarding existing political and economic matters, including existing treaty agreements between Jamaica and the US", until its engagement was terminated on February 8.
When contacted yesterday, JLP general secretary Karl Samuda said that he was unaware of the firm's latest claims.
"I can't help you at all, I am on my way to China, I am not in a position to comment. I don't know anything about what you're talking about. Call somebody in the JLP, call Mr Brady," Samuda said.
Information Minister Daryl Vaz, in the meanwhile, said that he was at a community meeting in his constituency but promised to 'investigate' the matter on his return to Kingston.
Repeated calls to Deputy Prime Minister and Foreign Affairs Minister Dr Kenneth Baugh went unanswered as well as to the JLP's public relations chairman, Andrew Holness.
But the disclosure has forced People's National Party's Dr Peter Phillips, who was the first to bring the Government's involvement with the firm to the attention of the Parliament in March of this year, to reiterate his call for a commission of enquiry into the matter.
"With relation to Manatt, Phelps and Phillips and the other matters arising from the extradition of Mr Coke and the handling of that request, we need a properly appointed commission of enquiry. It is clear that the Government has not been telling the country all the facts. It is clear that we are still being treated to a cover-up of sorts," Dr Phillips told the Observer last night.
He said that the Opposition was not ruling out bringing a resolution to Parliament to cement this call.
"It is not going to be a matter that goes away. More facts and matters are going to come out. It is not a private matter that can just rest with Mr Golding in consideration of the fortunes of the JLP," he noted.
In addition he said that matters, such as whether "monies were still owed", the terms of reference given to Manatt, Phelps and Phillips and the involvement of Government officials were yet to be made clear.
"There is a lot to be answered and it can't be just treated with disdain by a contemptuous government," Dr Phillips said.
It is still unclear whether or not the additional US$15,000 had also been paid by contributors to the party as said by the prime minister in relation to the source of the payment of the previous US$49,000.
The matter of Manatt, Phelps & Phillips' involvement emerged, following attempts by the US government to have Coke extradited, and subsequent efforts by the Jamaican Government to delay the process, citing several reasons, among them the illegal gathering of information by US authorities in respect of the extradition request.
Coke was captured last month and flown to the US to face drug-trafficking and gun-related charges, after he waived his right to an extradition hearing in Jamaica. He is being kept in a New York detention centre, pending trial.
If he is convicted of the charges, Coke could spend the rest of his life in prison.

I would like to get my back money from the govt. of Jamaica. They have no money to pay, Mr Shaw was offensively clear on that fact. Where will the money come from for a Commission of enquiry. Some old fat cat will just be getting fatter and uglier while the real workers in this country, doctors, teachers, nurses, police grin and bear it!!

Nothing will come of their subterfuge and we will just have to suck it up!! I remember a Jamaica when people would demonstrate peacefully to be heard.
Now there is no action just the 'wild west' as the govt is so corrupt, and so compromised they are at a loss to control criminals. There is no distinction between the government and criminals these days.

So if a review is done, then what? What the heck is a review necessary for? The political rigamarole is ridiculous, when either party is caught in the act of corruption why don't we enforce the same standards of booting them out, like we do with other individuals? Both parties are the least to say disappointing and disgusting. Because we don't hold them accountable (and I don't mean tribunals and inquiries, I mean jail time and relinquishing them of their positions), things won't change.

When the next election is called Bruce & Dor will be kicked out. Then we will have the inquiry. Bruce is "enjoying" being PM, all that he craved all his life and he wont cut it short no matter what. His shame & pride is gone like sammy mouth!

My be that is one of our problems, forget about it and move on. In matters like these one does not forget about it and move on, simply because we put our trust in those we hire to lead us. We expect them to obey the law, show some respect for our dignity, and not lie to us. Once they start they become suspect in everything they do; they are tainted. That is why the truth is required now, and those responsible step down.
SO, WHO PAID MANATT? Over to you PM.

@ devon brown .. One of the reason for all these problems in Jamaica is that there is a culture that accepts incompetence, corruption, and just about every negative thing that thwart progress. Jamaicans will have to become more proactive and demand higher standards from their public officials. We simply cannot sit back and let the politicians get their way. This is what they want but we should not tolerate this anymore. Enuf is enuf ..let's light a fire under their tails.

Typical day in Jamaican politics. So sad though that Jamaicans have been taken for a ride and viewed as a joke by these politicians who for whatever reason cannot be held accountable. The GOJ is still lying about specifics such as amount paid out, hoping that it all will go away. Unbelievable and plain ridiculous!!

Listen,there will be no enquiry, no resignation, no truth and nothing but the truth telling, the JLP has moved on and I think we better get used to this fact. I too would like to know if my taxes were used for this purpose but I have resigned myself to the possibility that I may never find out so like the JLP I am moving on.

The corrupt politicians in Jamaica are now learning that the American system requires full disclosures once something is put out there. For years politicians fool the people of Jamaica and rob them blind. Not one single senior politician in Jamaica has ever been to jail. The people who have the power to put them in jail turn a blind eye because they too benefit from the massive corruption. The poor and the uneducated are always the suckers. How many young people in jail for a stick of weed? Waht a corrupt country Jamaica has turned out to be since independence.

The publication of the emails between Douglas Leys--the SG of Jamaica, and the US law firm--MP&P, would go a far way in clarifying the basis on which MP&P continues to maintain that it represented the GOJ in talks with the US State and Justice Depts.
The PM indicated in Parliament that he would pursue such an angle, but nothing so far.

It's not just a CoE into the JLP/sitting govt's dealings with MPP that needed but that the end results of such are made public and those responsible for this imbroglio be called out and punished. If it means having to call early elections then so be it. We can no longer convene a CoE into gov't scandals and have the results buried as in the past. Bad behavior be public servants can and should no longer be tolerated.

OK it is time for heads to roll in the Bruce Golding administration. And it is time for the PM to step down. Too many lies and corruption here. Whoever was involved in the authorization of any payment to MPP must resign now. Somebody must be held accountable for betraying the public trust and using tax payers money to defend or protect a person (Dudus) accused of criminal activities.

I don't support any of the two P's but what with all this commission of enquiries? i was of the vie that the country broke.. these enquiries cost besides, i bet my bottom (and top) dollar that inquiry or not there is not a single thing to come of it. Bruce Golding begin the renewing of the minds in Jamaica with his new kind of politics up until Dudus...do we believe if he resign it will make life better? or do we believe the others can make things better... Jamaica wake up.

Extradition request came in Aug 09. Resistance hatched in Sept. By Oct 09 Observer reports homicides have risen dramatically in recent weeks At end Oct Lewin resigns. Makes you wonder whether a game plan was at play here. Were forces unleashed by underworld to create mayhem in an attempt to force particular outcomes

Oh what a tangled web we weave. It seems with each passing quarter as MP&P makes it declarations the government gets more embarrassed. Or do they? If this Govt would have seen fit to just tell the nation the truth and stop hoping that with that with Dudus gone the story will go, we would not be going through this again. What Bruce and company fail to realize the U.S is country governed by laws and Perjury is taken quite seriously. I just wish we could learn something from this episode.

As I said before, and I will say it again, Bruce Golding and his regime must go. I can't imagine the regime returning to power in the next general election. Also lets not forget that a large number of its members are citizens of other countries.

And the truth shall set Jamaica free... So a further JMD$1.3M on the nearly JMD$4.5M they (or is it we?) already paid... So roughly JMD$5.5M - roughly the same as the award to bring in Dudus. Can't wait to see the JLP termite defenders come out of the woodwork and talk about we should move on because Bruce said he was sorry and he was 'contrite' and because the PNP had scandals so they have 'no moral authority' to speak... It is all well and good for people to "move on". However, moving on while ascertaining the truth are not mutually exclusive, because we can do both.
Most importantly, the criminal aiders and abettors must be held accountable and cannot be allowed to repeat this bebacle.

Well, well here we go again.

Manatt simply will not go away and this Dudus affair is an albatross around the neck of the JLP and particular the party leader.
I too believe a full review of this entire process needs to take place at up-park camp and all guilty of violations including issues of National Security should be hauled before the court.
No review - No elections !!!
