Dear Editor, I am surprised that an erudite man such as Claude Robinson could say this in his Sunday Observer column of April 27: "The uncertainty now is whether the losing PNP candidate, Abe Dabdoub, will ask the Court of Appeal to award him the seat without the need for a by-election as the chief justice ruled."
The Court of Appeal will not be hearing new facts. It will merely look at the petition and consider if the Chief Justice erred. Dabdoub sought to set aside the nomination of Vaz and told the electors in that constituency that a vote for him would be a wasted one and that it would lead to him (Dabdoub) becoming MP by the ballot or through the courts. For him to seek anything but the removal of Vaz and the award of the seat to himself would negate the need for an appeal. If he is not seeking what you say is uncertain, Mr Robinson, then he would have abided by the Chief Justice's flawed decision and let them have a by-election.
