'Dudus' Judicial Review delayed

Follows affidavit by Lightbourne

THE application for a Judicial review filed by lawyers seeking to prevent the extradition of Christopher 'Dudus' Coke to the United States, has been delayed until Wednesday.

The matter was adjourned after Minister of Justice Dorothy Lightbourne filed an affidavit today to which Don Foote, Cook's lead attorney, said he needed time in which to respond.

Coke is wanted by the United States to face gun and drug trafficking charges. It was the signing of his arrest warrant that sparked attacks by gunmen on security forces and the ensuing State of Emergency.

He is seeking a Judicial Review of the decision by the justice minister, giving the authority to proceed with extradition proceedings against him.

The case before the Supreme Court does not prevent the police from executing the arrest warrant against him.

Can a fugitive apply for a judicial review? How about reviewing the thousands of backlog cases where those who have been accused are languishing in custody. Where is the public defender?

That's not a priority or even near the top of their to-do list.

Is it legal for a fugitve to be seeking to move the court?
One would have thought that his judicial rights become opreative only when he has placed himself in the hands of law and order. It seems unjudicial for one to openly flought the law and at the same time seek the assistance of the court in the very same matter.
The Chief Justice should declare that the court cannot even hear the matter until the fugitive has surrendered.
