TWO of the three men charged with the 2005 murder of financial analyst Jamie Lue are expected to be freed of the charges later this month.

They are Duane Owens and Andre West.

A third accused man, Lynford Allen, is expected to be tried for the murder.

Yesterday, a Crown representative told the court that the Crown did not have sufficient evidence to prove its case against Owens and West.

According to the Crown representative, Allen gave a statement, in the presence of his attorney, implicating himself and the other men.

However, he has refused to cut a deal with the prosecution to give evidence against Owens and West. Because Allen is an accused, his statement can only be used against himself and not against his co-accused.

The matter is set for mention on July 27 when a jury is expected to be empanelled so that a formal verdict of not guilty can be entered in favour of Owens and West. A trial date is expected to be set at the same time.

Lue, 25, a financial analyst at Alliance Capital Limited, was in December 2005 abducted in the Constant Spring area, robbed and killed while on his way to meet his girlfriend.

The body of the Orange Grove, Stony Hill resident was found in the back of his Honda CRV along Mayfair Avenue, at the foot of Beverley Hills on December 31, 2005.

Although Owens and West are to be freed of Lue’s murder, they are still not out of trouble.

The two — along with Rhyan Wilson, Trishana Spence and a female accused who was under the age of 18 when she was charged — are to be tried for the murder of Jamaica AIDS Support employee Steve Harvey in November 2005.

Yesterday, attorney Dr Randolph Williams made a bail application on Owens’ behalf but it was denied.

Harvey, 30, was abducted from his Kingston 20, home by gunmen and was later found dead on Pinewood Terrace on Wednesday, November 30. Harvey's ATM card and other items were taken. His stolen motor car was found parked at the football field at Markland Avenue in Grants Pen, St Andrew.

The accused are from an area called Vietnam in Grants Pen. Clothes, suitcases, jewellery, cellphones and watches belonging to both victims were also recovered.
