$96m fraud? - CG says 3 KSAC councillors, staff member involved

KSAC probing fraud allegations

THE Office of the Contractor General (OCG) said it has uncovered major fraud involving three councillors and a staff member of the Kingston and St Andrew Corporation (KSAC), and will be turning the matter over to the police.

According to the OCG, the alleged fraud involved some 114 Government contracts valued at more than $96 million, which were awarded between November 2006 and November 2010 by the KSAC.

Yesterday, head of the KSAC, Kingston Mayor Senator Desmond McKenzie said he has not been informed by the OCG who the implicated councillors and member of staff are, but an internal investigation has been launched into the matter.

McKenzie said the town clerk, the city treasurer and the deputy mayor will make up the team which has been mandated to investigate the matter.

He said the town clerk will be writing to Contractor General Greg Christie today to seek further details.

"The KSAC will be co-operating one hundred per cent with the OCG," McKenzie told the Observer.

In a release issued yesterday, the OCG alleged that the contracts, the majority of which were for gully and drain cleaning, were awarded to a fake female contractor who admitted to merely acting as a 'front' for the parish councillors and a staff member of the KSAC's Roads and Works Division.

The OCG said internal investigations revealed that the fake contractor fraudulently secured registration with the National Contracts Commission (NCC) as a Government works contractor and had listed three staff members on her NCC Contractor Re-registration Application Form. But the OCG said when the listed staff members were interviewed they disclosed that they neither knew of the woman nor had they ever worked for her.

"The fake contractor, who was summoned to the OCG to account for the discrepancy in the sworn representations which she had made in her Application Form, co-operated fully with the OCG and disclosed the extent of the alleged scam," the release stated.

Among the disclosures, which were made under the pain of criminal prosecution, according to the OCG, were the identities of the three councillors and the staff member.

Also disclosed was the fact that she did not know the so-called staff members who are listed on her NCC Contractor Re-registration Application Form, nor has any of the named persons ever worked for her.

The fake contractor is said to have further disclosed that she receives the contract awards or projects from the implicated councillors and staff member and that the projects are actually undertaken by agents of the named persons, but the said works are done in the name of her business, which is a 'front'.

The OCG said that after being paid the contract sums by the KSAC, she takes the money from the bank and pays over same to the implicated KSAC personnel who, in return, gives her a fee of 10 per cent of the contract sums.

The woman further disclosed that she did not have any construction or works experience, and that her role on the works sites is to "just stand and look from morning till evening".

The fake contractor is reported to have told the OCG that she has no staff employed to her "business" and that the workers who are engaged on the works sites are provided by the three councillors and the staff member. She is said to have worked with other councillors but could not recall their names.

"To facilitate her written application to the NCC to be re-registered as a Government contractor, she paid a fee of $15,000 to a named third party who, in turn, completed the NCC application form, inclusive of providing the particulars of the fake staffing information," the OCG stated.

Yesterday, McKenzie said while he was aware that the OCG was conducting an audit at the KSAC, his first knowledge of the allegations was when he was contacted by the media following the release of a statement by the OCG.

However, McKenzie said he is not just awaiting the OCG and the police findings, but have ensured that the KSAC embarks on its own investigation.

"We will not allow the public to wonder what our responses will be," McKenzie said.

Meanwhile, the OCG said since last year it has made several requests to the Government and the NCC for additional staff to assist in its scrutiny of works contractors' application forms so as to minimise delays in the NCC contractor registration process whilst ensuring that all fraudulent contractor applicants are removed.

"However to date, the OCG's requests for additional resources have fallen on deaf ears," it said.

"does Mr Christie work or his office work for the media?" Certainly not. Mr Christie work for the Jamaican people.
The media is the primary or the only source of information for a larger and larger percentage of the population.

Since the police will be told (if the paper is reporting the story in correct order as to action of the OCG) and any or all three found to be somewhere in a country that does not have extradition treaty with Jamaica, would we be blaming the OCG and Mr Christie for tipping his hand? Unlike this newspaper, the lead of another paper gave the impression that the OCG's press release was given after the matter was reported to the police. Will this be another KERN SPENCER corruption/fraud saga?

@ Chuck E- does Mr Christie work or his office work for the media? The CG uncovered evidence of fraud and the CG or his office call in the media with his findings and told them "WILL BE TURNING OVER THE MATTER TO THE POLICE." The very same police as you inferred nothing has ever been will be same one the OCG will be turning over the findings to, for possible prosecution. Ur query appears contradictory. Did the OCG give the media names? So what's the point rather than to fuel speculation.

I hope someone gets arrested because this is getting ridiculous. Secondly, I think by now there is enuf proof that CG needs to have powers to formally bring charges against individuals/agencies.

@Chuck, you do raise a valid point in that trust is something lacking, which may infuence Mr. Christie's to disclose information the way he does. Greg Christie is one of the few public officials who holds CREDIBILITY where I am concerned. He has proven over and over again that he is willing to do his job in a manner that is UNBIASED.
I wonder if he would be interested in representational politics. I would vote for him everyday of the week and twice on Sunday. Keep up the GOOD WORK Mr. Christie

@ Dr. Porteous the CG did say he knew which three councillors and the staff that facillitate this fraud. Why dont you just wait untill the invetigation is done before you draw the PNP in? Just a thought. Now that beins said Christie will not leave this investigation in the hands of the mayor. He did say he will be turning it over to the police. Mayor Mckenzie doing his own invetigation is all about saving face. How could this happen on his watch? Corruption i say runs deep.

I hope after a full and comprehensive investigation is completed we will see some people in jail. I hope they are from both parties, but dont stop there keep going you will soon get to the top where the PM and the leader of opposition is implicated in some scandal bigger than Dudus or Finsac. @ Dr Joan Porteous The timeline have in question is all desmond years. The present mayor has been in charge from before 2006. My question is why in almost every aspect of politics we have to wait til years after the fact to find out these things? how much of taxpayers money are spent on check and balance that is not working? this is a question of accountability and this goes to the head. Desmond you are accountable, you are the chairman of the council.

Good statement Ramon Castro, i fully support your comment, Mr Christie have the whole country eating out of his hand, he have proven that his judgement and honesty can be trusted, don't spoil that by doing the wrong thing, going to the media first, no that's not the way to go. i hope that this will be investigated to the highest level and the maximum punishment be delivered, like public hanging, or death by firing squad or bisecting of limb, but then again this is Jamaica criminality is ok.

This scheme and versions thereof are not unique to Jamaica. The question is what are you going to do about it in terms of criminal sactions and putting in place the checks and balances to prevent re-occurence?
It is instructive to note the silence to the OCG's request for additional resources. They want to starve it to death or kill it on the vine. Where is the game-changing "driva" PM?

Here we go again, $96 million of Jamaican taxpayers dollars going to clean drains & gullies, of which $9.6 million goes to an un-skilled, fake contractor to stand and look from morning to evening.
As far as I am concerned, the Mayor should also be held accountable, since the fraud/scam occour under his management. Needless to say who were the workers employed to do the fake job. That common sense, that all of us should know.

Why the mayor want to investigate this matter? shouldn't he know how funds are dispursed in the KSAC,He shouldn't be allowed in the office until the investigation by the police is completed,this office must be yellow tape and treated as a crime scene,This mayor as been running this office since 2002 therefore all of this happen under his watch.Before this week is over i'm hoping these gangsters are arrested and put before the court.Bruce here is one of the mayor who not overseeing his position.

@Ramon Castro, the purpose of an audit especially one into possible gov't malfeasance is not to tip off the sources within gov't that might be a party to the corruption and fraud. It might seem strange in a culture such of ours that the OCG did not give the Mayor a heads up or a blow by blow account of what is going on, but that it pretty common in countries, companies and cultures with a true system of audit & accountability. We know how easy it is for info to get passed on.

Mckenzie should resist conducting an investigation as a matter of principle as he will be investigated too. The phantom contractor gone hostile should be given state protection and offered immunity from prosecution if she agrees full cooperation with the investigations.

Now is the time for the people to get their permits & demonstrate & display their disapproval of this kind of behaviour from a govt. agency.
To think that they can fly in the face of the people in this manner!

@Ramon Castro : Mr Christie does not work for the "Mayor", or the "Police". Besides, he does not necessarily trust the same people that you may trust. No one needs to lecture Mr Christie about the way he does his job.
Are you aware of anything that was ever done, or action taken by informing the Mayor, or Police of corruption in Governance ?. Please direct your lecture to the alleged criminals !

Applaud your effort Mr Christie, however, fault you or your office for releasing the your finding to the media before the matter was turn over to the police and informing the Mayor. Don't we learn anything form the Dudus affair. Wouldn't be surprrise if the individuals involved are on a boat or are already in hiding. What would happen if the US told the media that they know where Osama was hiding. Don't let your zealousness to eradicate corruption cloud your judgment in applying common sense.
