THE Office of the Director of Public Prosecutions had still not up until Thursday, located the main witness in a case involving a police constable who has been charged with the 2003 murder of a colleague in Kingston

The prosecution had been trying to locate Christopher Hooper, whose last known address was 5 Oxford Street in Hannah Town, Kingston, to testify in the trial that started on Monday in the Home Circuit Court.

The situation puts the prosecution in a precarious position, especially with the court's refusal of its application for the witness' statement to be read into evidence under the Evidence Act.

Several witnesses have so far testified in the trial of Constable Deon Carr, including a police member of the Jamaica Defence Force with the police patrol at the time of the incident.

The prosecution is alleging that Carr, who is attached to the Hannah Town Police Station, shot and killed his colleague, Constable Halkeith Ergas, on the afternoon of May 23, 2003, after discharging his M16 rifle at a civilian whom the police had stopped minutes earlier, along Slipe Road.

Carr, according to the prosecution, had been poking the civilian in the chest with his rifle when the civilian commented, "Mind you shoot mi," and turned to the side. An explosion followed and Ergas, who was standing behind the civilian, was hit in the chest.

The trial adjourned early due to an issue with a juror.

Carr is being represented by attorney Valerie Neita-Robertson.
