THE Ministry of Transport and Works yesterday welcomed Contractor General Greg Christie's announcement that he intended to launch a special investigation into the circumstances surrounding the US$400-million contract to China Harbour Engineering Company (CHEC) Limited for the Jamaica Development Infrastructure Programme (JDIP).
The Office of the Contractor General (OCG), in a statement to the media yesterday, said it had taken the decision to conduct the probe following the failure of Permanent Secretary Dr Alwin Hales to substantiate a statement by Minister of Transport and Works Mike Henry that "...that the US$340-million loan being used to fund the (JDIP) project came from the China Ex-Im Bank with a pre-condition for a Chinese firm of their choice to undertake the programme".
The OCG said the minister's statement was made on June 27, 2011 after the contractor general issued a press release in which he outlined several concerns regarding the JDIP.
According to the OCG, it has had concerns from the outset that the JDIP, which represents the first major road works rehabilitation contract of that value and magnitude, had been awarded by the Government of Jamaica to a single contracting entity, CHEC, without competition.
The OCG said following Henry's statement it wrote to Dr Hales, asking him to provide, among other things, documented proof of the minister's assertions, as Henry had said that it was the China Ex-Im Bank that had imposed the selection of CHEC upon the Jamaican Government.
"The OCG's concerns in the matter were heightened further, particularly since a careful perusal by the OCG of the contractual and financing documentation, which the ministry had previously submitted to it, had failed to substantiate the minister's claims," Christie said yesterday.
The OCG said the failure by Permanent Secretary Hales to provide documents to substantiate Henry's claim about the need to select a Chinese contractor prompted the latest investigation.
"The commencement of the OCG's investigation will enable it to invoke its special powers under the Contractor General's Act as a judge of the Supreme Court of Jamaica to secure the information which it will now require to clarify the true circumstances surrounding the award of the JDIP contract to CHEC. Sworn statements, given under oath, will be solicited by the OCG from several persons, including Minister Henry and other senior public officials," Christie said yesterday.
Firing back, Dr Hales in a statement issued to the media following Christie's announcement, insisted that "the question from the OCG was correctly and appropriately answered".
"But the expectation that the answer would have substantiated the statement attributed to the Honourable Minister in the media was an assumption by the OCG. It is to be appreciated that the Honourable Minster never stated that there was a clause in the JDIP loan agreement requiring that CHEC be engaged as the contractor," Hales said.
He said the minister's statement "was based on advice given to him about the process, and references drawn from the sequence of events leading up to the conclusion of the loan agreement".
Said the permanent secretary: "In the whole process it was made clear to the Ministry of Transport and Works that the application for the Preferential Buyer's Credit Facility for the project must be accompanied by the commercial contract between the GOJ (Government of Jamaica) and the Chinese contractor. The application was transmitted by the Ministry of Foreign Affairs and Foreign Trade to the Chinese Government, via letter dated August 20, 2009," Hales said further.
He added that the "fact that the commercial contract had to be executed prior to the submission of the application to the Export-Import Bank of China for the Preferential Buyer's Credit Facility meant that it would be of no value to include a clause in the loan agreement requiring the engagement of CHEC".
"Indeed, had I been asked by the OCG to substantiate the Honourable Minister's statement, instead of being asked to point to a specific provision or clause requiring the engagement of CHEC, the matter would have been put into the appropriate context, including notation of the advice and information given to the Honourable Minister that would have led him to make the statement that he did," the permanent secretary said.

If the CG had powers of arrest then the majority of the JLP ministers, including the prime minister would be in jail by now, based on reports coming to us.
The PNP aside, this JLP government must know by now that they are the most corrupt, incompetent and arrogant government that has ever graced Jamaica House since independence.
They are saying that the Gleaner has a PNP bias. This is far from the truth. If this were so then they would be demanding that the PM show us the Paraguay cheque

I have the utmost respect for the CG , Jamaica really needs more like him I have one question though, Why is there always this media grandstanding about who and what he intends to investigate? He is a public servant cant he just simply do his job proceed with his investigations and THEN publish his findings Dunno something seems wrong to me about his sequencing , I sincerely hope that Ego is not now getting in the way as his is one of the few public offices left that Jamaica still respect

There are so many questions to be answered. From this Government take's over, most of the Money they have allocated is only for Road works. Millions have been waisted on the Gorge Rd. The conditions of our Hospitals are positively medieval. A population without medical care will not be able to occupy these Roads. How are we going to repay all this amount of Money?. They might as well tell these credit institutes to take the Country. When we can't pay they hold on to possessions, anything):

This is a bit complicated, who is speaking the truth?.The Chinese cannot dictate who must be the Contractors because the loan is from them. This is a large sum of Money, is it only on Roads it will be spent?. What about our Hospitals which are in a very out dated state, no proper Instruments, Ambulances, etc. What sort of planning and development is really taking place out there?. No funding for education and research. Is it only roads that are needed?. Is jamaic belonging to us anymore?...

It is very important also to re-visit the Road maintenance Fund Act (RMF) to determine if people unilaterally changed its provision without Parliamentary approval.
Secondly, whether monies were diverted to the NWA in breach of the Appropriations Act.
Lastly, what happened to the special consumption Tax on gasoline (SCT) ?. Was it paid into the RMF fund ?. Were withdrawals, disbursements and expenditures done in accordance with the provisions of the the RMF Act ?.

Is it only me or do others believe the chinese were used as a SHIELD to hid the SUBCONTRACTORS knowing the law can be subverted this way ? we already know bruce's hunting buddy got billions now we need an investigation to see who the other "subcontractors" are related to and who are their associates. Premeditated chicanery?Can someone go to jail to set an example??

What happens to Mike Henry if it's proven that he lied about the terms of the loan? Until that answer can be decisively given ( and he goes to jail or is at least fired with his political carrer being over if it's proven) then we can accept as fact this govt. is inherently corrupt and complicit in criminal dealings. The DPP should have special police to investigate and lock up politicians found involved in such practices,E.G. fraud and criminal enterprise.

What I woild like to see is an Independent assessment so that the matter can be put to rest with empirical evidence. We owe it to future generations.
The group could be drawn from Sociology departments from UWI and other Universities and colleges here and abroad which would then decide objectively based on certain defined criteria. Both sides could present their cases, both written and orally, probably with input from civil society.
This is something we need to do urgenty, before 2012.

I was watching "All Angles" on RJR when the leader of G2K Mr. Seiveright told Mr. Brown that the PNP was more corrupt than the JLP.
This corruption charge has been thrown about willy nilly since before the last elections by the JLP hoping some of the mud will stick. It did stick, because to my mind that is why the JLP came to power. And they promised open and honest government.
The people have since said that the JLP is more corrupt but the JLP children are disputing these polls.
