Lawyers for six men ordered extradited appeal decision
ATTORNEYS for the six men whose extradition orders were upheld by the Full Court in June, yesterday filed an appeal against the decision.
Those facing extradition are St Ann businessman Norris ‘Deedo’ Nembhard, who was in 2004 designated a drug kingpin by US President George W Bush; former police corporal Herbert ‘Scarri’ Henry; businessman Vivian Dalley; Robroy ‘Spy’ Williams; and his brother Glenford Williams; and businessman Luis Arias.
The men were ordered extradited in 2004 by then Senior Corporate Area Resident Magistrate Martin Gayle, stemming from the allegations by US authorities.
However, their attorneys took the matter to the Full Court seeking a writ of habeas corpus, vacating the 2004 ruling and for the men to be released from custody.
The Full Court – consisting of justices Lloyd Hibbert, Marva McIntosh and then Chief Justice Lensley Wolfe – on June 15 upheld Gayle’s ruling after a lengthy hearing, noting that there was sufficient evidence to support the charges on which the US is seeking to have the men extradited.
The matter is set to go before the Court of Appeal during the new court term, which begins in September.
