American fraud accused walks free
AMERICAN Benjamin Frank was on Friday freed of fraud charges arising from allegations that he failed to return $200,000 that he took from a Jamaica woman as part of a business wedding arrangement that did not materialise.
The Corporate Area Resident Magistrate’s court was told that Frank, who is of a Queen’s, New York address, came to Jamaica on November 25 to marry the complainant on a date in December in order for her to secure a United States visa.
He reportedly requested money to help with the wedding expenses and was paid $200,000 during a meeting at a hotel.
The court was told that the complainant reportedly requested, to no avail, a return of her money when she realised that she was being conned. A report was made and the accused arrested and charged with fraudulent conversion.
But after the allegations were read out, Senior Magistrate Judith Pusey said that she was not certain that Frank, who was represented by attorney Everton Dewar, had a criminal case to answer.
After consulting with the prosecution, no further evidence was offered against the foreigner.
Pusey advised the complainant to that she should seek redress in the civil court.
