Cabinet should comply with the OCG’s requests, say Holness
OPPOSITION Leader Andrew Holness yesterday urged the Cabinet to comply with requests of the Office of the Contractor General (OCG), in light of the legal opinion from Director of Public Prosecutions (DPP) Paula Llewellyn.
Holness, in a statement yesterday, said that in light of the earlier court ruling and now the DPP’s opinion, the Cabinet should immediately comply with the lawful requests of the OCG since it has not stated any reason within the law to justify its non-compliance.
“I believe there needs to be clarification of the question posed by the DPP as to whether ‘The Cabinet of Jamaica has the unfettered power to choose not to grant approval for disclosure of its documents without providing a reason, particularly in instances where the OCG requires the information for the good management of the affairs of Jamaica’,” Holness said in a release yesterday.
Holness said the Opposition Jamaica Labour Party had written to the Speaker of the House on February 27 seeking his intervention with regard to the Government’s unwillingness to comply with the lawful requests of the OCG, despite a court ruling in favour of the OCG on the said matter and no evidence as to whether the Government has sought a stay of the ruling.
Said Holness: “The good governance of the country depends of the Government adhering to the country’s laws. The OCG is a creature of Parliament. Its requests in this instance are lawful and the Government should comply.”
The Opposition leader, at the same time, advised the Government that its approach to issues related to the OCG, the country’s primary anti-corruption agency, risks tarnishing the good name of Jamaica.
