The case of the garbage truck driver involved in the death of the Clan Carthy Primary School student has been moved from the St Andrew Parish Court to the Home Circuit Court in downtown Kingston.

The shift took place after Director of Public Prosecutions (DPP) Paula Llewellyn’s Voluntary Bill of Indictment on Friday.

Under section two of the Criminal Justice (Administration) Act, the DPP, highest prosecuting authority in Jamaica, can prefer the Voluntary Bill of Indictment, which will move the case to the Home Circuit Court without a preliminary examination of the accused before a resident magistrate.

The accused, 52-year-old Alten Brooks of Nine Miles, Bull Bay, St Andrew, will go on trial for manslaughter.

He has been identified as the driver of the ill-fated garbage truck, which got out of control on the compound of Clan Carthy Primary School, overturned and crushed seven-year-old Benjamin Bair in October.

Brooks

has been remanded in custody until January 15 when the matter will be brought

before the court again.
