Estate needs to be administered to transfer land title

Dear Claudienne

I am one of three owners through a joint tenancy of a lot on Trust lands. The original purchaser of the lot is now deceased, but prior to his death he willed the lot to his adopted daughter and my mother who are now both deceased. However, before they died ownership of the lot was transferred to me and another person.

By letter dated August 27, 1996 and signed by a senior civil servant on behalf of the Permanent Secretary in the Ministry of Housing, we were informed that the ministry was in the process of preparing splinter titles for all of the lots on the Trust lands. By a further letter dated October 24, 1997 the ministry informed us that the splinter titles including the one for our lot would be ready “in the next few months”. The ministry said that the transfer of the lot to us would be completed when the splinter titles were ready.

Since that time we have heard nothing further on this matter. We are seeking your help in this matter as we would like to know if the splinter titles were prepared.

At our request an attorney-at-law at the Ministry of Transport and Works and Housing has researched the matter. Tell Claudienne notes that the lawyer has informed you by letter that since your mother has died, in order for her share of the duplicate title to be transferred to you, her estate must be administered. Please contact a lawyer to administer on her estate. The ministry said that once you have given them the grant of administration and your mother’s death certificate, they will be in a position to effect transfer of the duplicate certificate of title to you and the other person.

I am writing you on behalf of my sister who currently resides in Florida. She applied for her NIS pension in July 2012 when she was 65 years old and was told that her pension would be mailed to her in Florida. Well I have been calling but to date I cannot ascertain the status of her pension application, as In April 2013 I was told that it was forwarded in a batch to BOJ requesting a draft whichshe would receive by September 2013. When I called in October, howeveer, I was told that on the contrary, her application was still being processed.

On receipt of your e-mail on January 8, 2014, we contacted the NIS. They have advised Tell Claudienne that your sister’s pension claim was approved on October 16, 2013. NIS said that the pension cheque has been dispatched to her in Florida. Good luck.
