Dear Claudienne,

On Friday December 20, 2013, I purchased a two- speed four-wheel battery-operated Quad bike from Tait’s Clarendon Pharmacy for my son. The cost of the item was in excess of $30,000. On December 20 when the bike was assembled my son was able to ride it, but by the following day, it stopped functioning in reverse or slow speed.

I returned the bike to the pharmacy on Monday December 23, and the proprietor said that the problem was due to a defective switch. He promised to repair the bike and return it to me on Monday December 30, but when I went to collect it he said that it was not ready.

I asked the proprietor to bring the bike to my home when it was ready, but when he delivered it in mid-January and an attempt was made to ride it, I realised that it was still not functioning in reverse or slow speed.

When I called the proprietor he again advised me to take the bike back to the pharmacy.

After repeated unsuccessful attempts to find out from the proprietor the status of the bike, I contacted the Consumer Affairs Commission (CAC) in February 2014.

However, to date (June 3), the bike has not been returned to me. The proprietor has given dates on which the item would be ready but they have passed without the promised result.

The CAC advised me that on one occasion when they tried to reach the proprietor they were informed that he was overseas on business.

I am now at my wits’ end.

My child really loved this bike and I want him to have it.

I have never requested a refund, but I have asked for a warranty.

Please assist me to resolve this issue.

The secretary of the proprietor of Tait’s Pharmacy advised us that the proprietor would be willing to discuss the matter with Tell Claudienne, but we were not able to speak to him. However, the secretary told us that one of the bike gears was in need of repair and a replacement was ordered.

We note that you have informed us that the bike was returned to you “in good working order” on Saturday June 7.
