A man was last week hauled before the Kingston and St Andrew Parish Court for beating his 73-year-old amputee uncle with a broom stick after his uncle found out that he was the person who had been drinking his fruit juice and spoke up about it.

Charged with assault occasioning bodily harm is Andrey Dixon, of a Southside address in central Kingston.

The court on Thursday heard that whenever the complainant left his juice inside the refrigerator in his house, he would notice that someone was always drinking out some of the liquid and he later found out that it was his nephew.

On September 23 the complainant said he went home and heard his nephew inside, but he ran out as soon as he got inside and saw that some of his juice was missing.

The following day the complainant said he was outside his house when he remarked: “A mussi duppy a eat out my food and drink out my juice.”

The complainant said Dixon’s mother overheard him and said to her son: “A you him talk.”

An argument then resulted between Dixon and his uncle, during which the uncle was hit on his shoulder with the broomstick.

The matter was reported and Dixon was arrested and charged.

On Thursday when he appeared in court, Dixon pleaded guilty to hitting his uncle with the broom stick.

The prosecutor then asked the complainant if he was willing to go to mediation with the matter, but the senior citizen who resides next door to his nephew refused, saying that his nephew had brought “bad man” on him several times.

Additionally, he told the judge: “Him mother tell him to come and thump mi inna my mouth, say mi a scandal him.”

The judge, however, advised the complainant that he had nothing to lose by going to mediation, and that it would provide him with the platform to work out all of the issues that he has with his nephew, some of which will not be resolved if the court were to sentence Dixon.

Further to that, Judge Smith told the complainant that if he goes to mediation and that matter is not resolved then the case will come back before the court.

The complainant, after listening to the judge then decided that he would give mediation a try. Hence, the matter was referred to the Disputes Resolution Centre and a mention date was scheduled for December 11.

Dixon’s bail was also extended.
