KINGSTON, Jamaica — Reputed Klansman gang leader, Tesha Miller, who is accused of ordering the murder of Jamaica Urban transit Company (JUTC) chairman Douglas Chambers, was further remanded when he appeared in the Home Circuit Court this morning.

Miller has been in custody since October on a charge of accessory to murder before and after the fact.

The prosecution made an application under the Evidence (Special Measures) Act for two of the witnesses in the case to testify via link but Chief Justice Bryan Sykes indicated that he was unable to rule because no evidence was presented before the court to support the application.

“Generally speaking a court acts upon evidence, if there is no evidence there is nothing for the court to consider,” he said.

Furthermore Justice Sykes said he is unable to determine if the assertions from the Crown are true.

The Crown, for its part, indicated that it will make another application but did not say when.

Meanwhile, attorney Bert Samuels, who is representing the accused, agreed with the judge that the application was unsupported.

Additionally, Samuels indicated that his client was opposed to the application on the grounds that it will prejudice his client’s case, noting that the use of video link will possibly allow for the inference to be drawn that the witness is not testifying in court because his client is dangerous.

Also, he said the wrongful reference by the prosecutor to his client as being the head of a gang along with the special measure and the publicity will be further disadvantageous to his client.

The judge however assured him that there are measures in the common law to sufficiently address those issues.

According to allegations, Miller gave another alleged member of the gang permission to shoot Chambers.

It is alleged that the gang members were displeased that the JUTC chairman was giving extortion money to another gang.
