Airbnb boom or bust?

Jamaican Airbnb hosts are right to be watching the Jamaica Tourist Board Bill, 2025 closely. It is still under debate, but the proposals deserve attention now.
Under the Bill, all short-term rental operators would have to register, and some would also need a licence to operate legally. Penalties for breaches could be as high as $1 million or even prison time.
The ministry has suggested somewhat of a lighter/simpler category without the heavier hotel style compliance burden. This is registration without licensing for:
• Hosts who live on the same property and rent out no more than nine guest rooms.
• Owners in apartment complexes where the by-laws ban short-term rentals. Please note that registration would not override strata rules.
For the “small man”, this carve out, if it makes it into the final law, could mean operating with legal recognition. It offers real advantages, such as a clear legal standing and greater trust from guests.
Tourism Minister Edmund Bartlett in a press release reiterated that, “The JTB Act does not legislate taxation on accommodation or any other enterprise.”
Current Airbnb hosts and those buying a property to host should not shy away from formalities. Watch the Bill’s progress and get ready to meet the requirements.
