Siblings dispute property title after parents die without will
Dear Claudienne,
I am asking for some assistance. Our parents passed without leaving a will and there are four siblings still alive. My youngest sibling, without my knowledge, obtained a title in her name only.
What can I do?
Regards,
MP
Dear MP,
As your concern is about a legal issue, the attorney who Tell Claudienne contacted said that as a first step you and your other siblings need the services of a lawyer to lodge a caveat against the title for the property. The attorney said that how your sister got the title in her name will have to be determined by the court.
If your sister acquired the property through adverse possession, the other siblings would have to do a court application. But even if she did not acquire the property by adverse possession, the other siblings will still have to do a court application to cancel the title, the attorney said.
We wish you all the best.
