Is a fixed monthly ‘overtime allowance’ legal in Jamaica?

In Jamaica, does the concept of “overtime payment in lieu “ exist? Where does its legality hinge regarding strict adherence to the related labour laws? Can a company offer a fixed monthly sum to cover anticipated overtime without a legal meticulous calculation to ensure the amount adequately compensates employees for all overtime hours worked at the legally mandated overtime rate (typically time and a half or double time)?
Is it legal for a flat figure of, let’s say, $5000.00 per month that hasn’t been increased in a number of years to be considered as legal, or is this unlikely to meet the legal overtime obligations, especially considering potential increases in an employee’s wage and cost of living?
Furthermore, classifying this fixed payment as an “allowance” and also claiming it to be a part of an employee’s basic pay seems conflicting and appears to be a potentially illegal practice. From my understanding, basic pay usually refers to the standard hourly or salary rate, upon which overtime is calculated. An allowance is generally intended to cover specific expenses or duties separately from regular wages. Integrating a fixed overtime payment into “basic pay” could be seen as an attempt to circumvent proper overtime calculation and reduce the actual hourly rate used for overtime purposes. If the $5000.00 isn’t covering actual overtime worked at the correct rate, would it likely be a violation of Jamaican labour laws?
Advice on this matter would be greatly appreciated in the interest of public awareness.

Tell Claudienne requested the Office of the Permanent Secretary of the Ministry of Labour and Social Security to answer your question about overtime pay. The permanent secretary’s office has sent Tell Claudienne the following email response from Mr Alrick Brown, director at the Ministry of Labour and Social Security:
“The issue of overtime payment by law should only be addressed under the Minimum Wage Act. In this instance, the emailer mentioned a case about a monthly paid worker receiving a fixed payment in lieu of overtime, and wanting to know if it is legal.
Answer
Under the Minimum Wage Act, the conditionality which determines if the action is legal would have to be met using the minimum rates. For example, if 40 hours worked per week (5 to 6 working days) by law equates to $400 per hour. Any excess hours per week would be multiplied by $600 ($400 multiplied by time and a half (1.5)). If the total amount due per month using the minimum rates is less than what the company is presently paying per month, it is legal.
