FSC employees in hot water for failing to file statutory declarations
TWO employees of the Financial Services Commission (FSC) have been referred for criminal prosecution for failing to file their statutory declarations with the Integrity Commission (IC).
The two FSC staffers — Sacheaner Fuller and Tamica Afflick — are also accused of failing to provide any explanation for their non-compliance.
The IC’s investigation reports on the two, along with its indicative rulings, were tabled in the House of Representatives on Tuesday.
In the case of Fuller, a 12-page report indicates that she failed to file her statutory declarations with the commission for the period 2022 to 2024, contrary to law. According to the investigation report, Fuller “failed without reasonable cause” to make the filings. It said her failure constitutes an offence under section 43(1)(a) of the Integrity Commission Act (ICA).
The report said an investigation was launched based on a referral by the IC’s director of information and complaints.
The referral raised concerns that Fuller may be in breach of the ICA by virtue of her failure to make the mandatory filings for the listed years.
It was pointed out that with the deadline for filing having passed, the onus was on Fuller to provide the commission with an explanation as to what accounted for her failure to file the required statutory declarations, and to make arrangements to comply.
However, up to the time the report was filed in the Parliament, “the commission had not been approached by Ms Fuller concerning her failure to file the statutory declarations for the years in question”.
In the meantime, Afflick has been cited for failing to make her mandatory statutory filings with the IC for 2023.
The report stated that Afflick “failed without reasonable cause” to make the filing.
“It was found that Ms Afflick was required to file the referenced statutory declaration with the commission at the material time, and having failed to do so, committed an offence under the ICA,” the report said.
The investigation report said “no cause was advanced by Ms Afflick as to what accounted for her failure to file the required statutory declaration.
“Based on the foregoing, the Dl (director of investigation) finds in the circumstances, that a referral to the director of corruption prosecution is justifiable.”
