Rev Al Miller shows even judges’ rulings can be revisited
EVEN judges can be subject to judicial review. Next month, the high-profile case of Fellowship Tabernacle’s Rev Al Miller will go before the Judicial Review Court as he tries to overturn the decision by Resident Magistrate Georgiana Fraser to sit in judgment over him.
Miller is charged with perverting the course of justice and harbouring a fugitive in connection with the former Tivoli Gardens strongman Christopher ‘Dudus’ Coke, who was arrested with him in June 2010 on the Mandela Highway.
Miller’s defence team began arguing in February that Fraser should recuse herself because she signed the arrest warrant for Coke, who is now in jail in the US. She was also presiding when Coke waived his right to an extradition hearing.
The lawyers said they were not accusing Fraser of bias. The judge eventually decided that she would go ahead with the trial, but Miller’s team then demanded the judicial review, which is set for November 2, 2011.
