Court reserves judgement in Mandela Highway case
THE Constitutional Court on Wednesday reserved judgment in the so-called Mandela Highway case, bringing to an end the three-day hearing.
“We will be giving this matter a whole lot of consideration and provide a decision when that exercise comes to an end,” said Justice Carol Beswick, who sat with two other justices — Christine McDonald and Frank Williams — on the matter.
Judgment was reserved without a date being set after attorney Hugh Wildman completed his response to submissions made on behalf of the attorney general.
The claimant is contending that it has lost money as a result of the commandeering of the lane in November 2013.
On Wednesday, Wildman said the defendants in the case demonstrated, through the burden of proof that rests on them, that there is any justification for infringing the claimant’s rights.
