Woman on murder rap cries after bail refusal
A young woman who is accused of assisting her boyfriend of beating her neighbour to death on Wednesday left the Corporate Area Resident Magistrate’s Court in tears after she was refused bail by Magistrate Maxine Ellis.
The magistrate told the 25-year-old labourer, Chambanese Gardener, of Warika Road in Kingston that she was not going to grant her freedom as she was a danger to herself and to others.
Resident Magistrate Ellis told the court that she had tried her best with the accused to guide her on the right path, but the accused chose not to heed and has now gotten herself into deeper trouble.
“We have done so many things to help her but some people have to go through life and learn everything on their own,” she said.
“I am not going to offer you any bail. You just have to bite the bullet and stay,” Ellis said before remanding her until September 25.
The accused was first denied bail in July by Senior Magistrate Judith Pusey, who, in refusing her bail pointed out that she had been a participant in the court’s drug treatment programme but had abandoned the programme.
Gardener was arrested and charged for the murder of Oshane Bailey, 21, Heslop Road in Kingston.
According to a police report on July 4, about 4:30 pm, Gardener was home when she and her neighbour got into a dispute over the destruction of his flowers garden.
During the dispute, Gardener’s boyfriend, known as Archie, reportedly intervened and hit the complainant on his hand with a piece of board.
It is reported that Bailey went for the assistance of his friend and was attacked by both Gardener and Archie, who used a piece of board to beat him all over his body.
Following the incident, Bailey was taken to the Kingston Public Hospital where he died a day later.
Gardener was subsequently arrested and charged, while her boyfriend fled and is still being sought by the police.
