Ministry of National Security wants money back
THE Ministry of National Security says it has called on the advance payment guarantee, in the amount of $213,465,200, held by Mayberry Investments Limited on behalf of O’Brien’s Car Sales & Rentals.
In a release yesterday, the ministry said this course of action follows the failure of the company to provide the ministry, by a December 20, 2017 deadline, a detailed statement of account in respect of the advance made, so as to ensure full accounting for the money that was paid over to them.
The request, according to the ministry, was made on December 14.
“The contract clearly states that if the funds are used for any other purpose than purchasing vehicles it would be a violation of the terms of the contract and sufficient grounds to call the advance payment guarantee,” the ministry said yesterday.
Mayberry is expected to pay over the funds immediately, it continued.
Earlier this month, the ministry said it redeemed the Performance Security Bond in the sum of $42,493,040, following the company’s failure to fulfil the terms of the contract to provide 200 pre-owned vehicles for the Jamaica Constabulary Force.
O’Brien’s was paid half of the $426.9-million contract amount and should have delivered the vehicles by June of this year, but so far, only 30 units have been handed over.
The company’s failure to supply the remaining units after two extensions, had left 66 vehicles stuck at Customs.
In light of its call on the advance payment guarantee, the Ministry of National Security said it should be made clear that the 66 vehicles are still expected to be supplied.
O’Brien’s Car Sales & Rentals Limited was awarded the contract to provide the vehicles by the National Contracts Commission after a national public tender was issued in July 2016.
