Patrick Lynch fined, suspension revoked upon appeal
On Thursday, October 10, 2019 the Jamaica Racing Commission heard an appeal by trainer Patrick Lynch against the decision of the First Instance Tribunal arising from positive findings of Mepivacaine (Class 2 drug) in Another Bullet on September 27, 2017, Another Bullet again on October 7, 2019 and Zack on the Attack on October 14, 2019.
The First Instance Tribunal had made the following decisions:
– Disqualified both horses Another Bullet and Zack on the Attack from their respective races.
– Found that trainer Patrick Lynch failed to rebut the presumption of negligence in each case and therefore imposed a fine of ($200,000.00) in each case (totalling $600,000.00) to be paid immediately.
– Warned off trainer Patrick Lynch in each case for a period of one year.
After considering the evidence and submissions, the commission ruled at the appeal that:
– Both horses ( Another Bullet and Zack on the Attack) will remain disqualified from their respective races.
– In the case of Another Bullet on race day, September 27, 2017, the Commission increased the fine from $200,000.00 to the maximum fine of $250,000.00.
– The fines imposed by the First Instance Tribunal relating to Another Bullet on the race day of October 7, 2017 and Zack on the Attack on October 14, 2017 remain at $200,000.00 in respect of each totalling $650,000 to be paid within seven days.
– The warning off period imposed on Lynch by the First Instance Tribunal in respect of each case was removed.
