Tiktoker 119 returns to court on July 25
KINGSTON, Jamaica- Popular Tiktoker 119 will return to court on July 25 to face a malicious communication charge over social media posts made about a St Catherine woman.
When the social media blogger appeared in the St Catherine parish court on Friday, the case was put off. The accused, whose real name is Milton Wray, lacked legal representation when he had appeared in court a few days earlier. However, on Friday, an attorney appeared on behalf of the social media star.
The blogger said he would be challenging a section of the Cyber Crimes Act as he believes that the 2015 act impinged on key constitutional rights.
“I am having consultations with a prominent constitutional lawyer,” Wray told Observer Online.
“Multiple attorneys agree that section 9 of the Cyber Crime law is highly questionable constitutionally. Not only does it suppress free expression, but the law, in and of itself, has what is called in legal terms, ‘a chilling effect’, which means that it makes people afraid to talk.”
Wray pointed to the fact that there were three cases now before the courts including his, which showed that the law was being used to limit freedom of expression. He pointed to the cases of Dhana Warren, the woman seen in viral video allegedly inciting violence following the death of reputed don Othneil ‘Thickman’ Lobban and that of Marlon Plunkett, known as Kiprich, who was accused of using audio and audiovisual communication to promote criminal activity under Section 18A (b) of the Offences Against the Person Act.
“All three were charged by the Spanish Town CIB. The Spanish Town police are apparently using the law to go after its perceived enemies and enemies of its friends. The police are using this new law like a baton to trample on the rights of its citizens’ freedom of expression,” Wray claimed.
The allegations are that on March 22, Wray and the complainant went out to an entertainment event and afterwards, Wray allegedly invited the female to his home.
She reportedly refused.
It is further alleged that on March 29, he warned the woman that he was going to disgrace her.
The Clerk of Courts outlined that on March 30, Wray posted her picture on social media with alleged defamatory remarks.
The woman made a report to the police and an investigation was launched by the Spanish Town Criminal Investigation Branch, which resulted in Wray being charged with malicious communication.
