Appeal dismissed
The commissioners of the Jamaica Racing Commission (JRC) after a lengthy hearing yesterday dismissed the appeal lodged by the connections of first-past-the-post in the 2016 Jamaica Derby, Future King.
Future King was disqualified for causing interference and intimidation to both second-past-the-post Bigdaddykool, and third-place finisher, Orpheus.
Bigdaddykool was also disqualified, thereby remaining in second position. Orpheus, ridden by champion jockey Shane Ellis and trained by Anthony Nunes, was then awarded the race by the stewards. That decision now stands following the verdict of the commissioners of the JRC.
Following the reading of the judgement, Jeffrey Mordecai, a part owner of Future King, who marshalled the case for the appellants, then requested of the commissioners a seven-day stay of their decision in order to seek legal advice as to whether or not to proceed to the Supreme Court on points of law.
The stay of execution was granted by the sitting commissioners led by chairman of the JRC, Anthony Shoucair, with Solomon Sharpe, Charles Heholt, and Paul East being the other commissioners.
The JRC’s legal representative at the appeal hearing was former chairman of the commission and attorney-at-law Rudolph Muir.
Chairman Shoucair then informed that an official communication will be released by latest Monday of next week.
