Deane murder accused released into care of guardian
ST JAMES, Jamaica — One of three men charged by the police with the beating death of Mario Deane while in police custody in 2014 has been released into guardianship care.
The guardianship order was made by Justice Viviene Harris on Friday in the St James Circuit Court.
Damion Cargill, who is deaf, mute, and schizophrenic, was found unfit to plea by a seven-member jury on Monday, March 20 in the St James Circuit Court.
Justice Harris had two options before her — either to send him to a State facility or allow supervised care with his family, as stated under section 25c of the Criminal Justice Administration Act.
The latter was chosen by Justice Harris, who made her decision under the 7th schedule of section 25c.
Cargill’s attorney, Franklin Halliburton said his client was released into the care of his brother, Joseph, who has been entrusted with caring for him.
Halliburton added that two witnesses from the community who gave character witness spoke highly of Cargill’s brother, Joseph.
A consultant psychiatrist attached to the Cornwall Regional Hospital in St James is also expected to administer his treatment.
The probation office is also expected to submit a social enquiry report to the Registrar of the Supreme Court regarding Cargill’s progress and integration into the society on the first anniversary of his release into supervised care.
Cargill and several of his family members were in court on Friday.
Meanwhile, a pre-existing matter that had landed him in custody at the time of Deane’s beating in 2014 is to be called up at the beginning of the St James Circuit Court on September 18.
The case was transferred from the parish court to the circuit court.
On the other hand, the two other men in Deane’s case, Marvin Orr and Adrian Morgan, are also expected to make an appearance on September 18.
Deane was the 31-year-old construction worker arrested and held at the Barnett Street Police Station in Montego Bay for possession of a ganja spliff on Sunday, August 3, 2014.
However, Deane died three days later in hospital after receiving severe injuries to the head while in custody.
The three police personnel charged by the Independent Commission of Investigations in relation to the death of Deane are booked to make an appearance in the St James Parish Court on Monday.
The three cops — Woman Corporal Elaine Stewart, District Constable Marlon Grant and District Constable Juliana Clevon were all charged with manslaughter, perverting the course of justice, and misconduct in a public office.
