Lifeguard charged with brother’s murder gets $600,000 bail
ST JAMES, Jamaica – A St James lifeguard accused of choking his brother to death was granted bail in the amount of $600,000 following an application by his attorney in the St James Parish Court on Wednesday.
Dailando Bailey, 24, of a Catherine Mount , St James address, has been charged with the murder of 30-year-old Oshaine Bailey.
Wednesday was his first court appearance.
During his bail application, Dailando’s lawyer, Henry McCurdy, emphasised that provocation played a significant role in the incident, highlighting the circumstances that led to his client’s actions.
“The deceased jumped at him, they had an altercation, and he tried to defend himself…all he had done was hold him, and he held him too tight,” McCurdy explained.
Additionally, he pointed out that his client’s immediate decision to voluntarily approach the police and provide a detailed account of the events demonstrated his willingness to cooperate with the authorities.
Presiding judge Sasha-Marie Smith-Ashley then asked the defence counsel if he intended to shorten the proceedings by transferring the case to the Circuit Court, to which he replied that he would not do so because he would like full disclosure of all documents before the matter is sent to that court.
McCurdy also revealed that the death of his client’s brother had affected him and that his family was willing to help him with counselling.
Meanwhile, the court was informed that several documents, including the post mortem report, remained outstanding.
As a condition of his bail, Dailando is to report at a specific police station on specific days of the week. He was also ordered to surrender his travel documents and a stop order will be imposed at all ports.
He is to return to court on November 30.
According to reports, the brothers were at home on September 12 when an argument developed. It escalated into a physical altercation where it is alleged that Dailando choked his brother until he became unresponsive.
Oshaine was taken to hospital where he was pronounced dead.
Dailando reported the incident to the police which led to his arrest.
