Jamaica’s outstanding credit card balances have climbed to a record $94 billion, raising urgent questions about borrower protections, lender conduct, and the effectiveness of regulatory oversight.

Many consumers, advocates, and commentators argue that this surge is not only a product of post-pandemic spending and cost of living pressures, but also the predictable result of decades of weak supervision and little to no active enforcement of consumer protection mandates. Bank of Jamaica (BOJ) data confirms the scale: Commercial bank credit card receivables are at historic highs, leaving thousands of households in a precarious financial state.

The current climate suggests a systemic issue, wherein the burden of debt is shifted onto the consumer without sufficient guardrails:

• Predatory pricing and opaque fees: Without rigorous monitoring, lenders have few incentives to curb high interest rates, complex fee structures, or promotional offers that quickly convert into long-term revolving debt. For consumers with limited financial literacy, this creates a “trap” in which minimum payments barely cover interest.

• Aggressive sales tactics: Banks often prioritise the expansion of their credit portfolios over the suitability of the borrower. Cards are frequently issued with high limits that do not reflect the borrower’s actual ability to repay, setting the stage for future delinquency.

• A lack of deterrence: Enforcement is the backbone of market integrity. When regulators fail to impose tangible sanctions for misconduct, there is little external pressure on our financial institutions to reform predatory practices.

A central grievance for Consumers Intervention of Jamaica (CIJ) is the perceived absence of accountability for financial institutions. While the BOJ maintains an Office of Consumer Complaints and establishes codes of practice, there is a widely held, deeply frustrating allegation among the public that no financial institution has been meaningfully fined or sanctioned by the BOJ for consumer rights violations in over 50 years.

Whether this represents a deliberate policy of “soft” regulation or simply a lack of enforcement capacity, the effect on the consumer is the same: A sense that when a bank violates his or her rights, there is no “big stick” to protect them. This perceived immunity creates a lopsided playing field on which financial institutions operate with minimal fear of regulatory consequence.

The statistics represent real people struggling to navigate an unfair system. These accounts illustrate the patterns often reported by consumers:

• A small business owner was promised a low-interest introductory rate on a business card. Within six months, automatic rate hikes and hidden processing fees rendered the card unaffordable. When she tried to challenge the charges, the bank’s internal complaint process was a maze of delays and non-answers.

• A recent graduate was granted a credit limit far beyond his salary. When a short period of unemployment led to missed payments, collection fees ballooned his debt overnight. Despite his attempts to escalate the matter, he felt he had nowhere to turn for objective, regulatory support.

• A retiree reported being targeted by aggressive marketing for a “no-fee” card, only to find she was being charged monthly “account maintenance” and foreign transaction fees that ate away at her limited pension.

Stronger enforcement matters. To restore public trust and economic stability, the focus must shift towards:

1) Binding rules: Moving from voluntary codes of practice to mandatory, enforceable regulations on disclosure and fee structures.

2) Transparent sanctions: The public needs to see that misconduct leads to consequences. If institutions violate consumer rights, they should face public, financial penalties.

3) Empowered advocacy: The complaints mechanism must be more than a clearing house for grievances; it must be an active, transparent body that publishes outcomes and holds firms accountable.

The $94-billion credit card balance is more than a statistic, it is a flashing red light for the financial sector. For too long the narrative has focused on consumer responsibility while ignoring the institutional failures that enable debt to spiral.

If we are to build a healthy financial ecosystem, the BOJ must move beyond guidance and towards active, visible, and uncompromising enforcement of consumer rights. Without it, the cycle of debt will only continue to grow.
