THE First Instance Tribunal delegates of the Jamaica Racing Commission on November 30 conducted an investigation under Section 25 of the Jamaica Racing Commission Act into a report by the racing chemist that a urine sample taken from the horse Pocket Money on December 26 2014 indicated the presence of Clenbuterol, a prohibited substance under the Rules of Racing.

The split sample was subsequently analysed at the Chemistry Department of the University of the West Indies in the presence of the referee chemist where it was confirmed that Clenbuterol was present in the sample.

During the investigation the Tribunal heard evidence on behalf of the Commission, as well as evidence from trainer Conroy Tulloch.

After considering the evidence, the Tribunal:

– Accepted the finding of the racing chemist that the urine sample taken from the horse Pocket Money contained the prohibited substance Clenbuterol and pursuant to Rule 247 (1) of the Racing Rules, disqualified it from the race in question;

– Found that trainer Conroy Tulloch failed to rebut the presumption of negligence and imposed on him a fine of $50,000 to be paid within 30 days;

– Found that groom Clive Williams also failed to rebut the presumption of negligence and warned him off all courses and other places where the Rules of Racing are in force for a period of one year, and imposed a fine of $50,000 on him;

– Found no evidence to implicate owner Ewart Brown, and therefore discharged him.
