A landlord who pleaded guilty to hitting his tenant with a stone was sentenced to three months in prison when he appeared in the Corporate Area Resident Magistrate’s Court last Friday.

The man, Devon Weir, of Windward Road in Kingston, pleaded guilty with explanation to charges of assault occasioning bodily harm, possession of an offensive weapon, and indecent language.

The court heard that on the morning of January 24 this year, Weir used a stone to hit the complainant on her right ankle, causing bruises and pain.

The court was told that a knife was found in his possession when he arrived at the police station, and he was also charged for using indecent language at the station.

“Any reason why you shouldn’t go to jail?” Senior Resident Magistrate Judith Pusey asked.

In his defence, Weir said that he had an altercation with the complainant’s boyfriend and that during the argument he flung a stone at the boyfriend, adding that the complainant was struck by accident.

“How long you plan to spend in prison?” Pusey asked. “Mi nuh plan to spend nuh time. I didn’t fling it to hit her,” Weir responded.

“Me apologise to her. She is a quiet person,” Weir added.

“How [many] times you [have been] found guilty or [entered a] guilty plea?” Pusey asked.

“Put it a three, Your Honour,” Weir replied.

“How long you know me?” Pusey asked.

“Over three year,” Weir responded.

“You and I know it is more than three times; is time now yuh wet yuh foot. Is time yuh get what you asking for. Over the years you have been begging me, jucking me, imploring me to send you to prison. But every time you come you get a fine,” Pusey said prior to handing down the sentence.

Weir was subsequently sentenced to 10 days for possession of an offensive weapon, 10 days for indecent language, and three months for assault occasioning bodily harm. The sentences are to run concurrently.
