As the case surrounding TikToker Rosealee and her children continues to gain national attention, the road to regaining her parental rights could be long and winding.

While not commenting on the TikToker’s case specifically, the Child Protection and Family Services Agency (CPFSA) says there are certain requirements that must be met before children are returned to the care of their parents after being removed by the State.

Popular TikToker June “Rosealee” Dixon had her children removed from her care after videos surfaced online in which the social media personality revealed thoughts of physically harming her children.

The agency, in its statement when the news broke last week, said that it had received multiple anonymous reports of alleged abuse and indicated that Rosealee was consistently unco-operative during its investigation.

When quizzed on the likelihood of Rosealee’s children being returned to her care, the CPFSA, in a statement sent to the Jamaica Observer on Tuesday, shared that, while minors can, however, be returned to their caregivers if the court deems them fit enough to resume parental responsibilities, they were unable to comment on the popular TikToker’s fate.

The agency, which is charged with the responsibility of protecting children, said generally parents are required by the court to demonstrate their ability to adequately care for the physical and emotional well-being of their children before they are returned. It shared that for some cases parents may be mandated to seek counselling, while in others the children may be handed over to other relatives or be put into State care.

“Given that this matter is before the courts and under active investigation, we are unable to share details specific to the case,” the CPFSA statement read.

The TikToker’s case was brought before the court on September 19. Developments from that hearing are unknown at this time. It is, however, customary for the court, in the initial hearing, to grant an interim order for a period of 30 days for the CPFSA to conduct further investigations into the circumstances of alleged child abuse.

When the period for the interim order has expired the findings of the CPFSA’s investigation are brought back to the court to determine whether that child may be returned to their parent or caregiver, or if they should be placed into the care of the State under a Supervision Order or Fit Person Order.

In an interview with local media following the unfortunate events, Jakes, Rosealee’s partner, said he was willing to do anything to have his children returned to his care. He said the situation has left him heartbroken, as he was an active father.

He was also seen on social media showing receipts of materials purchased to begin the building of a home.

“This is a big move towards the first move towards the baby dem because me cyaan go a di court go tell the judge say mi waan mi yute dem and me nuh have nowhere to put dem,” he said.

Jakes was given massive support during recent TikTok live sessions as gifts poured in after he expressed the need to establish a stable home.
